Absolute Divorce Requirements

  • One spouse has been a resident of NC for at least 6 months before filing for divorce
  • Date of marriage
  • Date of separation
  • At the time of separation, it was the intent of at least one party to permanently end the marital relationship
  • Parties have lived separate and apart for at least one year and one day
  • There has not been a resumption of marital relations during the period of separation
  • Names/dates of birth of children or state that there were no children born of the marriage
